Civil Liability Act
The Civil Liability Bill was introduced into the House of Lords on 20 March 2018 and entered the House of Commons on 28 June 2018. It received Royal Assent on 20 December 2018.
The Ministry of Justice is reforming how damages are calculated in personal injury and clinical negligence claims, specifically addressing Section 2(4) of the Law Reform (Personal Injuries) Act 1948, which currently requires defendants to assume future care will be privately funded rather than NHS-provided. The reform aims to prevent double-payment by the taxpayer (compensation plus subsequent NHS care) and address outdated assumptions predating the NHS. The Road Traffic Accident (Personal Injury) (Amendment) Bill is the primary legislative vehicle, with active parliamentary scrutiny ongoing.
