The Finance (No 2) Bill 2017 contains powers to make regulations prohibiting a person from purchasing, acquiring, owning or being in possession of, or carrying out other specified activities in respect of, an item of tobacco products manufacturing machinery, except in accordance with a licence.

These draft regulations set out a licensing scheme for tobacco products manufacturing machinery. In particular, they make provision for:

  • the prohibition and exemptions from it
  • eligibility for licences
  • conditions and restrictions which may apply to a licence
  • applications for licences and variations and renewal of licences
  • penalties and forfeiture
  • enforcement
  • reviews and appeals

Full details of the scheme will be available in a published notice prior to April 2018 when we will start to accept applications for licences, before the scheme goes live on 1 August 2018. The information will be available on GOV.UK.
