Updated CMA transparency and disclosure statement, including new overseas investigative assistance guidance

The draft CMA6 sets out the CMA’s approach to transparency and information disclosure across its tools. The document is an updated version of the existing CMA6 that reflects developments in CMA practice, as well as legislative developments since 2014, in particular the Digital Markets, Competition and Consumers (DMCC) Act 2024.

The draft CMA6 also includes the CMA’s new draft Investigative Assistance Guidance (IA Guidance) at paras. 7.29 to 7.57.

The DMCC Act, among other things, gives the CMA new powers to conduct investigative steps on behalf of other international authorities (referred to as ‘investigative assistance’). This investigative assistance power will apply across the CMA’s competition, consumer protection and digital markets functions.

Please note that the section numbering in the consultation documents reflects the most recently published version of the DMCC Bill prior to its enactment, which may be slightly different from the numbering in the consolidated version of the DMCC Act when it is published in due course.
